Paternity

In Florida, if parents are not married when a child is born, fatherhood is not automatically legally established. Establishing paternity identifies a child’s legal father and gives important rights and benefits to the child, the mother, and the father. For example, the parents will both then have access to the child’s medical and educational records. Through this procedure, the parents will have the right to obtain court orders for child support, custody, and timesharing.

Step-Parent & Adult Adoption

Adopting a child is a momentous decision that often presents prospective parents with numerous legal hurdles. Further complicating matters, each type of adoption—whether through an agency or involving a stepchild or close relative—has a unique procedure. Once a final judgment of adoption is granted, the adoptive family permanently assumes all parental rights and responsibilities for the child.

Temporary Custody by Extended Family

Sometimes parents are temporarily unable to care for their child due to military service, temporary disability, or other reasons. Parents can assign temporary custody to an extended family member so that children’s access to health insurance and medical care, for example, are not interrupted.

Modification

Depending on the circumstances of a marriage, a divorce or paternity case ends with numerous court orders pertaining to custody, child support, alimony, and timesharing. While these orders should accurately reflect the needs of the family at the time of divorce, they may need to be changed in the future if significant events affect the operability of the agreements. For example, a modification may be necessary if one parent moves far from the other.

Enforcement

When a former spouse or parent fails to follow a court order following a judgment, there are options to enforce the Order. For child support, there are powerful collection tools at their disposal, such as wage deductions, income tax intercepts, driver’s license suspension, fines, and jail time. Sometimes enforcement relates to following through on other matters such as property settlement.
